Dilly Pass Terms of Service

Welcome to Dilly Pass! We help pickleball players find games, connect with other players, organize matches, and fill open spots.

These Terms of Service ("Terms") govern your use of the Dilly Pass website, applications, and related services ("Dilly Pass" or the "Service").

Dilly Pass is operated by Greenfield Ventures LLC, doing business as Genix6.

In these Terms, "we," "us," and "our" mean Greenfield Ventures LLC, doing business as Genix6.

By creating an account or using Dilly Pass, you agree to these Terms and acknowledge our Privacy Policy.

1. Who Can Use Dilly Pass

You must be at least 18 years old to create an account or use Dilly Pass.

You agree to:

• Provide accurate account and profile information.
• Keep your account credentials secure.
• Use the Service lawfully and respectfully.
• Maintain accurate availability and game participation information.
• Respect other players, organizers, and facility rules.

You are responsible for activity associated with your account.

2. What Dilly Pass Does

Dilly Pass is a platform for connecting pickleball players and organizers.

Depending on availability and your location, features may include:

• Finding and requesting spots in pickleball games.
• Creating and sharing Game Cards.
• Organizing games and managing participants.
• Joining Sub Benches and player groups.
• Receiving invitations and last-minute substitute opportunities.
• Planning recurring games and responding to availability requests.
• Discovering participating clubs and playing locations.

Some features may be limited to approved organizers, certain locations, or pilot participants.

Dilly Pass helps coordinate games but does not guarantee that a game, court, player, or playing opportunity will be available.

3. Game Invitations and Confirmations

An invitation, Game Card, or request to join a game is not a guaranteed reservation.

• Organizers control their games and may approve or decline participation.
• A spot is confirmed only when the organizer accepts the player and the Service reflects that confirmation.
• Organizers may change, cancel, or reschedule games.
• Players should update their participation status promptly if plans change.
• Waitlist placement does not guarantee participation.

Game details, including skill level, location, time, format, and fees, are generally supplied by the organizer.

Dilly Pass does not independently guarantee the accuracy of organizer-provided information.

4. SMS Notifications and Consent

Dilly Pass offers optional SMS notifications to help players and organizers coordinate games, especially when substitutes are needed quickly.

How you subscribe

You may subscribe on the Dilly Pass text-message sign-up page that an invitation link leads to, or in your notification settings, by entering your own mobile phone number, ticking the unchecked SMS consent box, and verifying your number with a one-time code. You can use Dilly Pass without subscribing to text messages.

Your consent applies to recurring Dilly Pass game-coordination text messages, which may include:

• New game invitations and available playing opportunities.
• Urgent substitute requests from organizers.
• Notifications about open spots and waitlists.
• Game confirmations, cancellations, and changes.
• Availability requests, reminders, and related service alerts.

Depending on your preferences and eligibility settings, these messages may relate to organizers and groups you have joined or other relevant games within the Dilly Pass network.

You only need to opt in once to receive recurring messages covered by this SMS program. You do not need to provide new SMS consent for each game or substitute request.

Your consent remains in effect unless you withdraw it.

SMS program conditions

• Message frequency varies based on game activity, your preferences, and available opportunities.
• Message and data rates may apply.
• Consent to receive SMS notifications is not a condition of purchasing goods or services.
• Messages may be sent using automated messaging technology through our messaging provider.
• Delivery may be delayed or unavailable due to carrier or network conditions.
• Mobile carriers are not responsible for delayed or undelivered messages.

How to stop messages

Reply STOP to a Dilly Pass SMS at any time to unsubscribe from the SMS program.

You will receive an opt-out confirmation, and Dilly Pass will stop sending all further recurring messages covered by the program, whichever organizer or group they relate to. Dilly Pass will not restart them until you make a new opt-in after your STOP.

You may also manage available communication and discovery preferences within your account.

Opting out of SMS may limit features that rely on text notifications or phone verification.

Dilly Pass does not use consent to game-coordination SMS as permission to send unrelated third-party marketing messages.

5. Organizers and Player Groups

Organizers are responsible for the games and groups they manage.

Organizers agree to:

• Provide reasonably accurate information about their games.
• Communicate relevant changes and cancellations.
• Respect player privacy and communication preferences.
• Avoid discriminatory, abusive, misleading, or fraudulent conduct.
• Comply with venue requirements and applicable laws.
• Use Dilly Pass invitations only for legitimate game-coordination purposes.

Organizers may share Dilly Pass invitation links in existing group chats, text conversations, or other communication channels, subject to applicable laws and the rules of those channels.

Recipients provide their own information when joining Dilly Pass. Organizers are not authorized to enroll other people in Dilly Pass SMS messaging without those individuals' consent.

Dilly Pass may limit organizer privileges or access when necessary to protect users or the Service.

6. Clubs, Courts, and Facility Fees

Pickleball facilities and clubs may be independently owned and operated.

Unless expressly stated otherwise, Dilly Pass does not own or operate the facilities where games take place.

Participation may be subject to:

• Club memberships or guest fees.
• Court availability and reservations.
• Facility rules and guest policies.
• Organizer requirements.
• Additional venue charges.

Dilly Pass does not override a facility's membership, access, reservation, or guest policies.

During the current free pilot, Dilly Pass does not charge players or organizers for basic account creation, Game Cards, or game requests. Facilities may charge their own fees, which Dilly Pass does not currently collect.

If paid subscriptions, passes, or services are introduced, their prices and applicable purchase, cancellation, and refund terms will be disclosed before purchase.

7. Player Profiles, Ratings, and Reviews

You are responsible for information you provide about your playing ability, availability, and preferences.

Unless explicitly identified as verified, skill levels and other player profile information are self-reported.

Where ratings, reviews, or participation feedback are available, you agree to provide truthful, relevant feedback and refrain from harassment, retaliation, or intentionally misleading submissions.

Dilly Pass may moderate or remove content that violates these Terms.

Player matching, invitations, and recommendations may depend on availability, preferences, eligibility, organizer decisions, and other relevant service information. They do not guarantee equal invitations or selection for every player.

8. Privacy and Location Information

We respect your privacy.

Dilly Pass may offer optional features that use your approximate area, preferred venues, or device location to help identify nearby games or confirm participation.

Where device-location permission is required, we will request it through the applicable device or application controls.

You can manage available privacy, discovery, and notification preferences through Dilly Pass and your device settings.

Joining a player group does not automatically make you discoverable to every Dilly Pass organizer.

9. Player Safety and Personal Responsibility

Pickleball and other physical activities involve inherent risks, including injury.

You are responsible for assessing your own fitness, playing conditions, equipment, and the suitability of a particular game or facility.

Dilly Pass does not supervise independent games, guarantee another participant's conduct, or provide emergency services.

To the extent permitted by applicable law, you voluntarily assume the ordinary risks associated with participating in games you choose to attend.

Nothing in these Terms excludes liability that cannot legally be excluded.

10. Acceptable Use

You may not:

• Harass, threaten, impersonate, or intentionally mislead others.
• Send spam or unsolicited commercial communications.
• Collect, scrape, or misuse other users' personal information.
• Create fraudulent games, accounts, reservations, or participation records.
• Circumvent another user's privacy or messaging preferences.
• Interfere with the Service or attempt unauthorized access.
• Use Dilly Pass for unlawful activities.

We may remove inappropriate content, restrict features, suspend accounts, or terminate access for violations.

11. Availability and Changes to the Service

Dilly Pass is evolving, and some services are offered as pilot or beta features.

We may add, modify, limit, or discontinue features, including access to particular programs or pilot locations.

We do not guarantee uninterrupted operation, delivery of invitations, the availability of particular organizers, or continued access to individual features.

12. Intellectual Property

The Dilly Pass name, branding, website, software, and original platform content belong to Dilly Pass or its licensors and are protected by applicable intellectual property laws.

You retain ownership of content you submit. You grant Dilly Pass a nonexclusive, worldwide, royalty-free license to host, process, display, and share that content as reasonably necessary to operate and improve the Service, consistent with your privacy settings and our Privacy Policy.

You may not copy, redistribute, or commercially exploit our platform or branding without permission.

13. Disclaimers and Limitation of Liability

To the extent permitted by law, the Service is provided "as is" and "as available," without warranties of uninterrupted operation, accuracy, or fitness for a particular purpose.

Dilly Pass is a coordination platform, not the organizer or supervisor of every game arranged through it.

To the extent permitted by applicable law, Dilly Pass is not responsible for indirect, incidental, special, consequential, or punitive damages arising from use of the Service.

Our aggregate liability for claims relating to the Service will not exceed the greater of $100 or the amount you paid directly to Dilly Pass during the 12 months preceding the event giving rise to the claim, except where applicable law requires otherwise.

These limitations do not restrict rights or remedies that cannot lawfully be limited.

14. Ending Your Account

You may stop using Dilly Pass at any time and request account deletion by contacting support@dillyleague.com.

We may suspend or terminate accounts that violate these Terms, create security concerns, or misuse the Service.

Certain records may be retained where reasonably necessary for legal obligations, dispute resolution, fraud prevention, and enforcement of these Terms, as described in our Privacy Policy.

15. Governing Law and Disputes

These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-law principles, except where applicable law requires otherwise.

Before initiating a formal dispute, you agree to contact us at support@dillyleague.com and attempt to resolve the issue informally.

Unless mandatory law provides otherwise, disputes will be handled in courts of competent jurisdiction in Colorado.

16. Changes to These Terms

We may update these Terms as Dilly Pass develops.

When changes are material, we will provide notice through the Service or another appropriate communication channel.

The updated effective date will appear at the top of this page.

Your continued use of the Service after updated Terms take effect constitutes acceptance, to the extent permitted by law.
